I had this text book overnighted to me due to the fact that my campus bookstore didn't have it in stock. I paid the shipping then found out later that the book had been updated and my classmates were all using the fourth edition. The editions are rather similar and the book is still helpful. There are enough "real time" examples as well as charts & graphs to make this a necessary text for Health Politics. The appendix section is also noteworthy.

Well I will concede that this staple of civil procedure classes in law school is a good read, but let's do the math. When you see what Stern's firm took and you see what the victims got, we know that the law firms were the winner's here and the people who lost their lives and homes with all their possessions did not fair very well at all. For that reason, it's probably a good introduction to class action litigation.

Suggested reading for pre-law school students, this book contains the representing attorney's actual story about a lawsuit involving the coal industry. The terminology, processes and struggles included in the story, as well as the lawyer's thought-processes and actions introduce the reader to the real world of legal advocacy, which is not parallel to the Law & Order dramas on television. If you're contemplating entering the legal profession, this book narrates one situation with enough detail to give you a feel for the work you may be doing.

Win for Stern overshadowed "win" for victims

This book was on my law school reading list. I was supposed to read it before school started but never got around to it. Now that I've graduated, I decided to read it. I enjoyed the beginning. I was stirred by the description of what happened when the dam broke. I perceived empathy in the author's tone. Immediately, I was pulling for the victims, regardless of whether they were significantly impacted by the flood or only had minimal contact with the disaster. But, as the book went on, the tone changed. I felt like it was more a story about Stern. The author seemed to become more boastful. It also seemed like he spent a long time thoughtfully writing the beginning of the book, then rushed to finish it at the end. The end was not as compelling as the beginning. The end was slightly unsatisfying. Overall, this is an interesting book that tells the story of what happened in Buffalo Creek and a self-appraisal of how Stern thinks his lawyering was during the case. The downside is that the end turned into a story about Stern's "win" in negotiating a settlement instead of a win for the victims. The book would also be well-served by print of a second edition with an epilogue. You'll end up asking yourself how much the survivors really did win, and whether there truly was a lasting impact on coal companies.

There are lawyers who do good

I was assigned to read this for my Civil Procedure class in law school. Although I dreaded reading it, once I started, I could not put it down. As a law student (or if you are a lawyer for that matter), this was a great insight into how a lawsuit is constructed on such a grand scale. Even if you have no interest in law, Stern manages to tell such a compelling story, I would recomend this book to anyone. It provides great insight into the operations of a corrupt coal company, a state and region at the industry's mercy, and people who felt helpless when their lives were destroyed by the mining company's negligence and the state's oversight. A definite must read.

I too had to read this book for my Civil Procedure class. Let me start off with the positive. With the coal disaster that just happened in Utah, I thought it was quite interesting that the response was the exact same by the coal mining owners. Both Piston / Buffalo Mine Co. (from the book) and the Utah mine owner prematurely said the disasters were an "act of God," without yet knowing all of the facts. And I do think Stern did a good job at getting the reader very upset with the coal companies. However, that was where the positives ended for me.

First off, there were so many spelling / grammar errors, that I lost count. Did Stern have someone proof read the book? The errors are so obvious, I can't believe someone didn't catch it. Now, as for the substance of the book, Stern provides WAY too much detail. He could have cut the book literally in half. I know Civil Procedure teachers like this book since it is so comprehensive and talks about diversity and all that, but I just felt like there was way too much unnecessary detail in the book. Although, I read through all the boring / unnecessary parts, because I thought it would be a good ending. Wrong! By the title of the book I expected that the plaintiffs would be set for life. Which was hardly the case. I don't want to give away the final number, but let's just say that at the very beginning Piston offered $10,000 each for the wrongful deaths. And after all the time and energy, the plaintiffs only got $13,000 each. And they actually got a lower amount because in their net recovery had to be adjusted for the expenses and legal fees of the case paid to the lawyers. In fact, Stern doesn't even list a net amount, adjusted for legal fees and expenses, that the plaintiffs took in because I think it would be too embarrassing. Ok granted, that Stern was able to get the original 200 something plaintiffs up to 625 because he filed for the each person, even the children, and not just the families. Thus, the families did take in more than they would have gotten originally, since it around $13,000 each compared to $10,000 as a family as a whole. But I would hardly say that they beat Piston. Stern had originally asked for $64 million; which in settlement talks immediately went down to almost half that at $32.5 million. Then he was trying to negotiate between their high number and Piston's low number of $3 million. And if you think he even got the middle number between 32.5 and 3--well, you would be wrong. I actually think Piston won! They had insurance to up to $17 million. And well, the settlement number was way below that. This made me so mad because I do think Stern had made a case for wanton and reckless and not just negligence. I know this was in the 70's and everything must be adjusted for inflation, but I still don't think this was a great number. Basically what happened is that the plaintiffs just got the same initial settlement that Piston offered, but it was for each person affected by the disaster including the children. This is hardly a win in my book. And what about the people that maybe just lost a spouse and they had no children between them? They would have been better off just settling immediately. They could have gotten the money right away. Stern at the beginning of the book laughed off Piston's $10,000 wrongful death settlement amount. But isn't this just what the plaintiffs got for their lost ones except years later?

What is very interesting is that Stern and his lawyers got off with a cool $3 million. And he boasts "sometimes you do well by doing good." He is way too self-righteous. Just because the lawyers may have done well doesn't mean the plaintiffs did well. And just because he calls it a "win" doesn't mean that it is such. After everything that these people went through, I feel they got screwed twice over, first by Piston/ Buffalo Mining Coal Co. and then by a self-righteous lawyer who made bank off of them. And Piston / Buffalo made off fairly well. Will someone who liked this book please explain to me how the plaintiffs "won?" Because I just don't get it.

This was written by three of my former professors at the School of Taxation at the University of Florida. The text mirrors why I enjoyed their classes and took 38 hours under them. It puts a rather complicated IRS Code interpretation into easy to understand practical applications.

Buy the 13th edition if you need the 14th!

Hey everybody! We're all looking for a little break on the price of textbooks right? Sometimes buying an old edition is a little scary b/c you never know how far off it will be from the new one? Well, this is your lucky day b/c I took the plunge and sprung for the old edition. Guess what--The old edition is, at most, 3 pages off from the 14th all the way through chapter 18 (b/c that's as far as we got, but I'd be it's the same the rest of the way too!). Granted, problems were switched around, though rarely, and maybe the numbers in the problems would be different, again, rarely, but it literally took me just minutes to update entire "parts" (chunks of chapters). If you're looking to save a buck, buy the 13th edition and spend an extra few minutes in your school's library. Happy shopping! This is definitely one of those times it's worth it.

Difficult To Understand The Main Issues

This text includes cases that involve a lot of the accounting numbers without a lot of explanation about the tax principles that were used in deriving the numbers. The best supplement I have found is the Eighth Edition Federal Income Taxation supplement by Stephen Lind and David Hudson put out by the Black Letter Series by the West Group recommended by my professor which was written by one of the authors of the casebook.

This book is a must-have for educators. Since the push for inclusion means many students with disabilities are entering regular schools and classrooms with their peers, it is of great worth that the regular teacher as well as the special education teachers know the background of the laws that pertain to these students with diverse needs. It would be beneficial to both students, teachers, and parents to know and understand how the laws are applied in court, what an IEP is, what is expected of the teachers, and what can be expected of the students. I have the other major law books on disability laws, but this one is more geared toward other participants in the process besides lawyers. It is very readable and very understandable without having to go to law school to get a background in law first. I suggest this or rather recommend this to my friends and students who are interested in working with those with disabilities in regular school settings. I found the material to be well-organized, clear, and thorough. The graphics and exercises further served to reinforce the material. The textbook though should have embedded additional examples that pertained to calculations (e.g. penalty calculations). Overall, the textbook is a strong choice to educate the readers in the methodologies and legal underpinnings of federal tax research and the workings of the Internal Revenue Service. Instructors can gear the material for students of varying aptitudes.

This book is absolutely great!!! It centers around the insight that Moses was given the secret for attracting everything in life, and that this secret was given nearly 3,500 years ago.

Interestingly, James Twyman reveals that the effective use of the Moses Code depends more on what you're willing to 'give' rather than 'get.'

Excellent read. Read in only 3 days. I couldn't put it down. I wanted to know how it worked. I've read the Secret and other Law of Attraction books but this one takes it to a different level. I've applied things that he said to do and my personal, business and finanical life has changed for the better. It was amazing. You'll want to re-read just to stay on your path. I read this in conjunction with Debbie Ford's "Why Good People Do Bad Things".

I didn't know what to expect the first time I read this book. However, James Twyman shows you how to create the law of attraction in your life, with a different version - so to speak. His personal experiences are massive when he uses the Moses code to create wonderful things in his life.

Aside from the contracts themselves, the author provides you with a negotiating checklist for each contract to help you edit the documents to meet your personal job needs. It also helps prepare you for presenting the contract to your customer. Lots of helpful tips as well.

One type of contract that I found missing is a release that allows a client to print and display the photos without totally transferring the copyright over. I like to keep my own rights to my work, while allowing clients to use them as well.

The index could be easier to use. I tend to have to hunt for some types of contracts. Still, this book is a resource that is well worth it's price.

Good form letters and documents for any photographer. A CD is supplied with a soft copy of the forms. All forms are customizable so an established photographer can cut and paste specific wording for their own documents.

I bought this book and its utter waste of paper and money. There are much better forms available for free to be downloaded from the internet. This book is completely useless for anyone who lives outside USA. I think Americans are smart enough to google the kind of forms they are looking for.

this book is a must if you are a photographer starting a business. the book includes dozens of contracts for most photographic jobs, with a detailed description of each, including the meanings of each section of a contract. the included CD gives you a digital form for each contract, in several file formats, including MS Word and Adobe Acrobat.

A must-read for serious, individual inventors

This hefty volume is the best I've seen for its detail and advice to serious inventors. It goes well beyond generalities and contains very specific advice on the idea protection process. Almost everybody has idea(s) that they consider patenting at one time or another. When you get to that serious stage with an idea (as I've been), and even if you plan to work with a patent attorney (as I am), the specific information in Mr. Pressman's series show a clear roadmap to follow to save time and money. He doesn't say, "Find a service to evaluate the marketability of your idea;" he gives companies, institutions, contact names, phone numbers, and Web sites. And very pointed advice to stay away from those close-cover-before-striking inventor services.
He includes the forms, language, fees, and instructions that will either intimidate you from pursuing a patent, or encourage you that your idea is patentable and how to get it done. I'm still reading my well-marked, dog-eared copy, working toward using his licensing advice.

It's a good book for someone starting out with the patent application process. However, after reading the entire text, then re-reading specific sections, it felt like a lot of cheerleading. There are a ton of excellent examples and explanations on why certain sections should be written in specific ways. And you can't go wrong for the price. I'm now looking at the 'How to write a patent application' by Sheldon:

Nolo has the annoying habit of giving you diluted books that ask you to buy other books of theirs to round out your knowledge of a given subject. This is no exception. I was interested in filing a provisional patent. This book has info about it, but kept referring to another book. This is perverse given how easy it is to file a provisional patent. On top of it all, there was some misleading information about the order of sections, and no useful info on filing online (I had to learn this from the USPTO site itself through a lot of digging). What's more, the book is fairly simplistic and "for dummies" when it comes to discussion of patent law - I have read better books (not how-to guides) on that. The book is not bad, just keep in mind that it is limited and definitely not a one-stop shop.

The book is basic, informative and I find myself referring to it when we cover some less than crystal-clear topics in class. Law 101 is nothing if not informative about our legal system and its roots in English Common Law, but it despite the author's best efforts, it reads like a reference book. The average person on the street would probably not be able to absorb much, despite what the blurbs on the jacket say, but it may be a good primer for potential law students.

The book basically does what it claims it's going to do. It gives you a clear and relatively simple overview of the American legal system. Furthermore, it constantly uses Supreme Court cases as a way of showing how certain laws were created and constantly changed over time as standards changed.

The writer doesn't get preachy or starts to discuss complicated theories and philosophies about law. He simply educates the reader on practical matters of our legal system. Some examples include how a typical case reaches the courtroom, the different kind of jobs attorneys and lawyers have, and how to write a legitimate will that will be recognized by law.

Overall, it's a great book for anyone that might be interested in Law School in the future or just someone that wants to be knowledgeable about the basic concepts of law.

excellent introduction to law

For those with an interest in learning what the law is all about, this is a really great place to start. As others have mentioned, it will be an excellent choice for those who are contemplating law school or paralegal studies. The author does a great job of condensing important information on a variety of different areas within the law, and making them interesting by putting the material into context with everyday life. Since the author wants to make the point that the law is something that can be accessible and understood by all, the writing is in a user-friendly and very readable style. This book is worthwhile and enjoyable reading for anyone with even the slightest interest in American law.
